Welcome to HUNGER. These Terms and Conditions govern your use of our platform and the purchase of products and services from our marketplace. By accessing HUNGER, you agree to comply with these terms.
1. Account Eligibility and Use
Age Requirement: You must be at least 18 years old to use the platform or make purchases.
Responsibility: You are responsible for maintaining the confidentiality of your account and password.
Fast-Track Orders: While our '3-click' checkout is designed for speed, the platform provides a summary of your order for review prior to final confirmation in accordance with CAA requirements.
2. Pricing and Payments
Tax Inclusion: Prices displayed are inclusive of all applicable taxes. Where a merchant is not VAT-registered, the price shown is the final retail price.
Transparency: Delivery fees are shown separately before the final confirmation click.
Payment Authorization: By placing an order, you authorize us to charge the total amount to your chosen method via PayHere.
3. Cancellations and Refunds
Strict Cancellation Policy: Orders cannot be cancelled once the Merchant has accepted the order or started food preparation.
Refunds: Please refer to our separate Returns and Refund Policy for conditions regarding non-perishable goods.
4. Shipping and Force Majeure
Delivery Estimates: Shipping times are estimates and may vary based on your location in Sri Lanka.
Unforeseeable Events: HUNGER is not liable for delays caused by "Force Majeure" events, such as fuel strikes, extreme weather, or civil unrest.
5. The "Merchant" Buffer and Indemnity
Facilitator Status: HUNGER shall assist consumers in ensuring product safety and quality during the post-purchase stage as required.
Safety & Quality: HUNGER is not responsible for food quality, hygiene, or preparation.
Indemnity: You agree to indemnify HUNGER against any claims related to food-borne illnesses or product defects from third-party merchants.
6. Governing Law
Jurisdiction: These terms are governed by the laws of the Democratic Socialist Republic of Sri Lanka.
Dispute Resolution: Any disputes will be settled exclusively in the courts of Colombo.
7. Service Verticals (Non-Goods)
For transportation, cleaning, repairs, tours, and waste pickup, HUNGER acts as an agent for the service provider. Professional and regulatory obligations (e.g., licensed drivers or registered tour operators) rest solely with the service provider.
8. Merchant Identification
The identity of the specific merchant or service provider you are contracting with will be clearly disclosed on the order confirmation or booking page.
9. Intellectual Property
All platform IP, trademarks, and content are owned by Bridge Of Mobile Technology Pvt Ltd. Users are prohibited from scraping or copying platform data.
10. Platform Availability
While we strive for 100% uptime, HUNGER does not guarantee uninterrupted access and is not liable for technical failures during service bookings.
